Solicitor General Elena Kagan's nomination to the U.S. Supreme Court comes to the Senate floor for a full vote this week. Recently, I announced that I will oppose her and, accordingly, voted "No' on her nomination in the Senate Judiciary Committee. I regret that Ms. Kagan was not more forthcoming in answering questions during the Committee's hearings, and believe it's important to have a thorough and spirited floor debate on her nomination before a final vote. If confirmed, Ms. Kagan will serve a lifetime appointment on our nation's highest court, and Texans deserve to know what type of a judge she will be if confirmed. One of my primary concerns coming out of the hearings was her apparent reluctance to impose constitutional limits on congressional and executive power.
