Rosen Helps Introduce Senate Resolution to Defend The Constitutionality Of The ACA

Today, U.S. Senator Jacky Rosen (D-NV) announced that she will co-lead a resolution in the Senate with Senator Joe Manchin (D-WV) to defend protections for those with pre-existing conditions. This comes after the House passed legislation last week that included core provisions from Rosen's resolution to defend the constitutionality of the ACA and its pre-existing conditions protections.

"I'm proud to join Senator Manchin in introducing the same resolution I championed in the House," said Senator Rosen. "Without these critical protections, we risk going back to the days when big insurance companies could deny insurance coverage based on a pre-existing condition. We cannot let the Trump Administration move to dismantle our health care system. I know just how important this issue is for Nevada's hardworking families and I'm prepared to keep fighting to protect their health care."

BACKGROUND: Rosen's resolution would authorize Senate Legal Counsel to intervene in Texas vs. United States -- a pending lawsuit in federal court, on behalf of the U.S. Senate, in order to defend the constitutionality of the Affordable Care Act's coverage protections for people with pre-existing conditions.

In the House, Rosen's resolution was co-sponsored by the Ranking Members of all House committees of jurisdiction in addition to Democratic Leader Nancy Pelosi and Democratic Whip Steny Hoyer. The resolution had nearly 190 co-sponsors by the end of the 115th Congress.
