Cramer Statement On House Winning Obamacare Lawsuit

Congressman Kevin Cramer made the following statement after a Federal District Judge ruled today that the Obama Administration has been improperly funding the cost-sharing Obamacare subsidy program without Congressional authority.

"The court made the right decision today by repealing this unlawful Obamacare subsidy program. Article I of the U.S. Constitution is clear. Congress is the only branch in the Federal government with the authority to appropriate federal funds. This decision highlights what's been going on for years -- the Executive Branch is willing to circumvent Congress whenever the laws do not match President Obama's agenda. Simply put, President Obama has broken the law, which is why the House of Representatives took this case to court in the first place. It doesn't matter if you're a Republican, Democrat, or Independent, it is always in the best interest of the American people to have a President who is willing to work with Congress, not against us. Our Federal government is made up of three co-equal branches. It's time for the executive branch to acknowledge that reality. The separation of powers is critical to our exceptionalism."

The judge will continue allowing the subsidy program to continue, pending appeal. If the ruling stands, it will repeal a significant portion of the subsidy program within the Affordable Care Act which pays for health care services.
