Judicial BranchCI-132 would add a new section to Article VII of the Montana Constitution stating that Judicial elections shall remain nonpartisan. Montana has used nonpartisan judicial elections since 1936. If the amendment is approved by voters in November, making judicial elections partisan would require another voter-approved constitutional amendment to enact.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Article VII of The Constitution of the State of Montana is amended by adding a new section 12 that reads:
Section 12. Nonpartisan Judicial Elections. Judicial elections shall remain nonpartisan.
