Title: Prohibits Gender Transition Care for Minors

Vote to pass a bill that prohibits gender transition care for minors in Michigan.

Highlights:

  • Defines “sex” as an individual's immutable biological classification as male or female (Sec. 3).

  • Prohibits health care professionals from providing the following practices that attempt to affirm a minor’s psychological perception of their sex that does not align with their sex assigned at birth (Sec. 5):

    • Prescription of puberty-blocking drugs;

    • Prescription of testosterone, estrogen, or progesterone in an amount greater than what would be produced in a healthy person of the minor’s sex and age;

    • Performance of a sterilizing surgery such as a castration, vasectomy, hysterectomy, oophorectomy, orchiectomy, and penectomy;

    • Performing a surgery that artificially constructs tissue with the appearance of genitalia such as a metoidioplasty, phalloplasty, and vaginoplasty; and

    • Removal of otherwise healthy or nondiseased body parts or tissue.

  • Exempts the following situations from the previous prohibition (Sec. 5):

    • When a minor is born with medically verifiable disorder of sexual development;

    • When a minor is determined to not have a normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action for their sex;

    • Treatment for an infection, disease, or disorder caused or exacerbated by the performance of a legal or illegal gender transition procedure; and

    • When a minor suffers from a physical disorder, injury, or illness certified by a physician that would risk imminent danger of death or major bodily function impairment unless surgery is performed.

  • Authorizes a person alleging violation of this Act to bring an action for injunctive relief, damages, or any other appropriate remedy (Sec. 7).

  • Authorizes someone who had a prohibited practice or procedure performed on them as a minor to bring an action after reaching 18 years of age but not after reaching 38 years of age (Sec. 7).

  • Authorizes the attorney general to bring an action to enforce this Act (Sec. 8).
