Vote to adopt a conference report that prohibits state and local law enforcement agencies in Hawaii from entering into agreements to cooperate with or engage in federal immigration enforcement.

Highlights:

• Prohibits any state or local law enforcement agency from entering into an agreement under any federal law allowing them to engage in immigration enforcement (Sec. 2).

• Prohibits state and local law enforcement agencies from (Sec. 2):

• Inquiring about an individual’s citizenship or immigration status unless it connects to an investigation into a violation of state or county law;

• Providing federal immigration authorities with information to assist in immigration enforcement;

• Providing non-publicly available personal information to federal immigration authorities;

• Allowing federal immigration authorities to interview people in state or local custody, unless required by law or court order or consented to by the individual;

• Detaining an individual on the basis of a hold request;

• Transferring an individual to federal immigration authorities unless authorized by judicial warrant or determination of probable cause; and

• Otherwise assisting or cooperating with federal immigration authorities by providing time, money, facilities, property, equipment, vehicles, personnel, databases, surveillance technology, communication systems, or other resources for civil immigration enforcement.

• Specifies that nothing in this Act shall be construed to prohibit law enforcement from enforcing state criminal laws, complying with judicial orders, or providing information that is expressly required by state or federal law (Sec. 2).

• Specifies that this Act takes effect upon approval (Sec. 4).
