Vote to pass a bill that authorizes the classification of individuals based on biological sex in certain circumstances in New Hampshire.

Highlights:

• Amends the Law Against Discrimination to authorize the classification of individuals based on “biological sex” if it serves the state interests of protecting people’s privacy rights and physical safety (Sec. 1).

• Authorizes such classification based on “biological sex” in the following circumstances (Sec. 2):

• The construction, maintenance, operation, and use of lavatory facilities;

• Athletic or sporting events and competitions in which “biological males” are generally recognized to be advantaged in physical strength, speed, or endurance; and

• The construction, maintenance, operation, and use of prisons, houses of correction, juvenile detention centers, juvenile commitment centers, mental health hospitals, mental health treatment centers, and any facility of involuntary commitment.

• Defines “biological sex” as the male and female biological sexes (Sec. 2).

• Specifies that this Act shall take effect 60 days after its passage (Sec. 3).
