Title: Limits Wisconsin Administrative Code Rules to Seven Years Unless Renewed
Vote to amend and pass a bill that limits Wisconsin Administrative Code rules effective length to seven years unless renewed.
Prohibits an agency from using words or phrases that are outdated or that are now understood to be derogatory or offensive (Sec. 6).
Requires the legislative council staff to report to a committee, when it is considering readoption of a chapter of code, any actions taken by a standing committee or the joint committee for review of administrative rules the last time a readoption notice was considered (Sec. 13).
Requires that each chapter of the code expires on the January 1 of the 7th year after the year in which a rule creating or readopting that chapter of the code takes effect (Sec. 15).
Requires any chapter of code that was in effect on the effective date of this act, and that is not repealed and recreated by January 1, 2035, to expire then (Sec. 15).
Requires the joint committee for review of administrative rules to consult with affected agencies within one year of the effective date of this act to establish a schedule for the expiration of all chapters (Sec. 15).
Specifies that this subsection does not apply to emergency rules (Sec. 15).
Authorizes an agency to submit a notice that it intends to readopt an expiring chapter between January 1 and March 1 of the year preceding its expiration, and specifies that the notice must contain the following (Sec. 15):
A brief statement explaining the basis and purpose of the chapter; and
A reference to each statute relevant to any rules in the chapter, and an explanation of the agency’s authority to enact rules under those statutes; and
A statement affirming that all rules in the chapter are in compliance with this act and not in need of revision due to changes of state or federal law.
Authorizes any member of either standing committee or of the joint committee for review of administrative rules to object to readoption of the code chapter within a 40 day period of submission of a request to readopt (Sec. 15).
Authorizes the agency to, if a committee member objects to readoption of a chapter, enact a rule to readopt one chapter per rule with or without changes (Sec. 15).
Authorizes the joint committee for review of administrative rules to extend the expiration date of a chapter for up to one year upon request by an agency (Sec. 15).
