Vote to pass a bill that prohibits government entities in New Jersey from collecting and sharing certain personal information.

Highlights:

• Prohibits government entities from requesting or collecting information related to a person’s immigration status, citizenship status, place of birth, social security number, or individual taxpayer identification number from an individual or non-governmental entity (Sec. 4).

• Exempts situations in which this information is necessary to assess eligibility for, or to provide or administer a requested public service, benefit, program, or professional qualifications and licensure from the previous prohibition (Sec. 4).

• Specifies that the information collected under the exempt circumstances must not be disclosed except when required for the provision of state services, required by a judicial order, or taken by an election agency to verify a candidate’s citizenship (Sec. 5).

• Prohibits the government or health facilities from selling, sharing, or transferring automated license plate recognition information except when permitted by law,  judicially ordered, or transferred to another jurisdiction with the purpose of assisting any criminal investigation not related to civil immigration enforcement (Secs. 5 & 6).

• Specifies that government entities that obtain, disclose, or use such information for unpermitted purposes shall be subject to injunctive relief and held liable for damages (Sec. 5).

• Prohibits health facilities from requesting or collecting information related to a patient’s immigration status, citizenship status, place of birth, social security number, or individual taxpayer identification number (Sec. 6).

• Exempts situations in which this information is necessary to assess eligibility for, or to provide or administer a requested public service, benefit, or program (Sec. 6).

• Prohibits any officer, employee, or contractor of the New Jersey Motor Vehicle Commission from knowingly disclosing or otherwise making available any personal information about any individual obtained by the commission in connection to someone’s motor vehicle record (Sec. 7).

• Exempts situations in which personal information must be disclosed in matters of (Sec. 7):

• Motor vehicle or driver safety and theft; 

• Motor vehicle emissions; 

• Motor vehicle product alterations, recalls or advisories; performance monitoring of motor vehicles and dealers by motor vehicle manufacturers; and

• Maintenance of voter registration information; and removal of non-owner records from the original owner records of motor vehicle manufacturers to carry out the purposes of certain safety laws.

• Specifies that this Act takes effect immediately, aside from Section 6, which takes effect on the first day of the thirteenth month following enactment (Sec. 9).
