Vote to pass a bill that authorizes restrictions for digital media use for minors in Illinois.

Highlights:

• Defines “covered manufacturer” as a manufacturer of an internet-enabled device, an operating system provider, or an application store (Sec. 5).

• Defines “covered developers” as individuals who own or control a website or other online applications that are accessible to citizens of the state (Sec. 5).

• Requires covered manufacturers that have an account setup feature to provide an accessible interface at setup that requires the account holder to indicate the birth date, age, or both of the primary user of the device for the purpose of providing data on the age of the user to covered developers (Sec. 10). 

• Specifies that the covered developers must only send the minimum amount of information to comply with this act and shall not share the information with a third party except where legally required (Sec. 10).

• Requires covered manufactures to provide an accessible interface that allows an account holder to indicate the birth date, age, or both for devices setup before January 1st, 2028 (Sec. 10).

• Specifies that a person who violates this Act is subject to civil penalty for each affected child (Sec. 10).

• Specifies that a covered developer is not liable under this act if the covered developer relied on the data provided by the covered manufacturer (Sec. 10).

• Defines “covered platform” as a public or semi-public profile for the purpose of allowing users to create or post content that is viewable by other users (Sec. 15).

• Specifies that a parent or legal guardian may override default privacy settings (Sec. 15).

• Prohibits notifications between 10:00 p.m. and 7:00 a.m. to be sent to users from social media platforms (Sec. 15).

• Specifies that this act is effective on January 1st, 2027 (Sec. 99).
