Vote to pass a bill that prohibits drag and other cabaret performances outside of designated locations in Ohio.

Highlights:

• Exempts breastfeeding individuals from the prohibition against indecent exposure (Sec. 1).

• Defines “adult cabaret performance” as a performance in a location other than an adult cabaret where minors may be present that features any of the following (Sec. 1):

• Topless dancers;

• Go-go dancers;

• Exotic dancers;

• Strippers;

• Performers who exhibit a gender identity that is different from their biological sex using clothing, makeup, prosthetic or imitation genitals or breasts, or other physical markers; or

• Other performers who provide entertainment that appeals to a sexual interest.

• Defines “adult cabaret” as a nightclub, bar, juice bar, restaurant, bottle club, or similar commercial establishment that regularly features any of the following (Sec. 1):

• Individuals in a state of nudity or seminudity;

• Live performances which expose an individual’s private areas or sexual activities; or

• Films or photographs that are characterized by their feature of an individual’s private areas or sexual activities.

• Prohibits any individual from engaging in an adult cabaret performance in a location other than an adult cabaret (Sec. 1).

• Classifies a violation of this Act as a crime of the following degrees (Sec. 1):

• A misdemeanor of the first degree if a minor is present;

• A felony of the fifth degree if the performance involved is considered obscene; and

• A felony of the fourth degree if the performance is considered obscene and a minor under the age of 13 is present.
