Vote to adopt a conference report that prohibits state and local law enforcement from entering into federal immigration enforcement contracts in Virginia.

Highlights:

• Prohibits any employee of a law-enforcement agency from assisting, cooperating with, or using resources to help with civil immigration enforcement, unless presented with a judicial warrant or judicial subpoena (Sec. 1). 

• Prohibits law enforcement agencies from maintaining, renewing, or entering into any federal immigration enforcement agreement unless it complies with the following conditions (Sec. 1):

• Immigration and Customs Enforcement (ICE) provides the names and ranks of all federal agents involved in any immigration enforcement activity at least 7 days before engaging in such activity and allows for investigations of agents if they are involved in a shooting;

• Any federal agents within the state must comply with all applicable laws of the state while conducting any immigration enforcement activity, including no activity on school property, faith-based organizations, or courthouses; and

• Any federal agent shall be clearly defined as an agent of ICE and shall not have any other form of identification (such as Police or any police vehicles or equipment) while conducting immigration enforcement activity.

• Requires any law-enforcement agency that has an existing agreement as of July 1, 2026 to obtain in writing, by September 1, 2026, a modified agreement that complies with the conditions above (Sec. 1). 

• Specifies that any agreement that violates this section shall be void and unenforceable (Sec. 1). 

• Authorizes the Attorney General to enforce provisions of this section by seeking injunctive or declaratory relief (Sec. 1).
