Vote to pass a bill that authorizes lawsuits against governmental entities and businesses in Idaho that do not separate bathrooms by sex.

Highlights:

• Prohibits individuals from using the opposite sex’s restroom unless the following are met (Sec. 1):

• The facility is a single occupant restroom and is designated for family use;

• The restroom is temporarily designated for the opposite sex’s use; or

• The restroom is the only facility reasonably available at the time of required use so long as no one of the opposite sex is presently in the facility.

• Authorizes employees to enter the restroom of the opposite sex to clean and maintain the facility if the opposite sex is not using the facility (Sec. 1).

• Authorizes law enforcement officials engaged in official activities or custodial staff to enter the facility (Sec. 1).

• Authorizes a family member or legal guardian to assist an individual in the restroom if assistance is necessary (Sec. 1).

• Requires governmental entities to provide reasonable accommodations to individuals who are unwilling or unable to use a multi-occupancy restroom (Sec. 1).

• Authorizes civil action if any individual encounters a member of the opposite sex in the improper restroom or facility (Sec. 1).

• Specifies that this act is effective July 1, 2026 (Sec. 4).
