Title: Increases Penalties for Impaired Driving Resulting in Death
Vote to pass a bill that increases the penalties for impaired driving which results in death of any person in West Virginia.
Increases the mandatory minimum and maximum length of imprisonment for individuals convicted of driving while impaired and causing the death of any person, including an embryo or fetus, from between 3-15 years to 5-30 years (Sec. 1).
Increases the mandatory minimum and maximum fine for such conviction from between $1,000-$3,000 to $2,000-$6,000 (Sec. 1).
Specifies that an individual convicted of a violation described by this section is not subject to assignment to a housing center for young adult offenders or for home detention if it is found that the individual acted with deliberate disregard for the safety of others (Sec. 1).
