Title: Authorizes Firearm Owners to Store Firearms with a Federally Licensed Firearms Dealer or Law Enforcement
Vote to pass a bill that authorizes firearm owners to store their firearms with a federally licensed firearm dealer or law enforcement in Ohio.
Authorizes individuals who legally own a firearm to store a firearm with a federally licensed firearms dealer or a law enforcement agency upon application and agreement (Sec. 1).
Establishes the following terms for storage of a firearm with a licensed dealer (Sec. 1):
The dealer may not enter into a storage agreement if their federal firearms license will expire during the term of storage, unless they have submitted a timely renewal application;
The dealer shall follow all federal laws regarding acquisition, transfer, and disposition of firearms;
A dealer may establish its own policies regarding the acceptance and return of a firearm; and
No dealer may return a firearm to a person if returning it would result in a direct violation of a state or federal law.
Establishes the following terms for storage of a firearm with a law enforcement agency (Sec. 1):
The agency may establish policies regarding the return of firearms; and
No agency may return a firearm if returning it would result in a direct violation of state or federal law.
Specifies that this section does not require a licensed firearms dealer or a law enforcement agency to accept a firearm for storage (Sec. 1).
Establishes immunity from civil action for licensed firearms dealers and law enforcement agencies that store firearms (Sec. 1).
Authorizes a court to award reasonable costs and attorney’s fees to an individual from whom a stored firearm is illegally withheld following a demand for the firearm’s return (Sec. 1).
Specifies that any information submitted in an application or agreement to store a firearm is confidential (Sec. 1).
