Title: Requires Detention Centers to Maintain Real-Time and Publicly Available Lists of Those who are Detained

Vote to pass a bill that requires detention centers in Nevada to maintain real-time and publicly available lists of those who are detained.

Highlights:

  • Requires a justice court whose jurisdiction includes a corridor established pursuant to section 46 of this act to reduce a report before July 1 of each year, which includes the following (Sec. 10):

    • The number of persons charged, convicted, and sentenced for any offense punishable as a misdemeanor in the corridor;

    • The underlying crime for which persons were charged, convicted, and sentenced;

    • The rate of successful completion of the sentence or condition of release; and

    • The number of persons subject to an order prohibiting a person from entering the geographic boundaries of a corridor. 

  • Requires a justice court meeting the description above to submit a monthly report not later than the last day of each calendar month, including the following (Sec. 10):

    • Total number of cases involving offenses punishable by misdemeanor; and

    • Whether the person is a repeat offender for an offense committed within the corridor and the duration of time that has passed between offenses, the condition of sentences, and whether the person was incarcerated.

  • Requires the juvenile court to order a mental health evaluation of a child at the detention hearing if the court has not ordered an evaluation in the previous year (Sec. 15).

  • Authorizes the juvenile court to order the Department of Motor Vehicles to issue a child a restricted driver's license if it finds that the suspension of a driver's license is not in the child's best interest (Sec. 17).

  • Requires detention facilities in the state to create and maintain a list of those detained, including the names of each person and the facility where they are held, which shall be made available to the public (Sec. 30.5).

  • Authorizes the establishment of an alternative correctional program for the reentry of offenders into the community (Sec. 33).

  • Prohibits school districts from granting access and providing educational information without a lawful order/warrant (Sec 46.5).

  • Establishes prison sentences and fines for individuals convicted of driving intoxicated where the incident causes the death of another person (Sec. 53).
