Title: Establishes New Regulations Regarding Review Hearing for Incapacitated Individuals
Vote to pass a bill that establishes new regulations regarding review hearings for incapacitated individuals in Pennsylvania.
Requires courts to hold a hearing within 30 days of the filing of a petition to terminate or modify guardianship of an incapacitated individual (Sec. 1).
Authorizes courts to hear a petition to terminate or modify guardianship by an incapacitated individual after more than 60 days of the petition’s filing if any of the following conditions are met (Sec. 1):
Interested party wants to participate in the hearing;
Counsel for the incapacitated individual needs time to prepare;
Interested parties need time to prepare; or
Medical evaluation needs to be completed.
Specifies that courts may decline additional review hearings if a petitioner has participated in a review hearing within the past 180 days and no new facts have been raised (Sec. 1).
Specifies that this Act takes effect 60 days after passage (Sec. 2).
