Title: Requires the Total Amount of Rental Deposits to be Refundable Upon a Tenant Vacating the Premises
Vote to pass a bill that requires the total amount of rental deposits to be refundable upon a tenant vacating the premises in New York.
Establishes that no deposit or advance shall exceed the amount of one month's rent (Sec. 1).
Establishes that the entire amount of the deposit or advance shall be refundable if the tenant vacates the property unless damage (Sec. 1).
Requires the landlord to provide the tenant to inspect the premises with the landlord or their agent before beginning occupation (Sec. 1).
Requires the landlords to provide notice of inspection at least 48 hours in advance when the tenant intends to vacate (Sec. 1).
Requires the landlord to provide the tenant with an itemized statement of the deposit that is retained after the vacating of the property (Sec. 1)
Requires the landlord to bear the burden of proof for the reasonableness of the deposit retained in case any portion of the deposit is withheld (Sec. 1).
Requires persons who violate provisions of the section to be liable for damages (Sec. 1).
