Vote to pass a bill that establishes stricter standards for the prosecution of those accused of driving under the influence of marijuana in Ohio.

Highlights:

• Defines “tetrahydrocannabinol” as naturally occurring or synthetic equivalents of the substances contained in the plant or resinous extractives of cannabis, or derivatives, and their isomers with similar chemical structure to delta-1-cis (Sec. 1).

• Prohibits individuals from operating any motor vehicle or water vessel with a concentration of five or more nanograms of tetrahydrocannabinol in their blood (Sec. 1).

• Authorizes a court to infer that an individual is under the influence of marijuana in violation of this Section if any of the following apply (Sec. 1):

• They have a concentration of at least 25 nanograms of tetrahydrocannabinol per milliliter of their urine;

• They have a concentration of between two and five nanograms of tetrahydrocannabinol per milliliter in their whole blood; or

• They have a concentration of at least five nanograms of tetrahydrocannabinol per milliliter in their oral fluid.

• Specifies that the inference that an individual was under the influence of marijuana may be supported or rebutted by either party with evidence or testimony, and the court shall consider all relevant and competent evidence (Sec. 1).

• Specifies that the admissibility of evidence or testimony regarding the presence of an illicit substance in an individual’s system does not limit the admissibility of either of the following (Sec. 1):

• Any evidence or testimony regarding the analysis of an individual’s whole blood, blood serum or plasma, urine, breath, oral fluid, or other bodily substance; or

• Any evidence or testimony regarding the method, process, reliability, or equipment used in the process of analyzing any of those bodily substances.
