Title: Prohibits Immigration Enforcement from Obtaining Medical Information from Healthcare Providers without a Valid Warrant
Vote to concur with House amendments and pass a bill that prohibits immigration enforcement from obtaining medical information from healthcare providers without a valid warrant.
Prohibits health care providers from disclosing service information regarding a patient without obtaining authorization, except when disclosure is compelled by any of the following (Sec. 2):
A state or federal court;
A board or commission for purposes of adjudication pursuant to its authority;
A party to a proceeding before a court;
An arbitrator or arbitration panel;
A valid search warrant;
A patient; or
A medical examiner.
Authorizes health care providers to disclose health care information pursuant to the following (Sec. 2):
Purposes of diagnosis or treatment of the patient;
Payment of health care services;
Billing and medical date processing for health care providers;
Review of health care providers’ competence or qualifications;
Accreditation of health care provider;
Investigation by medical examiner;
Health care research and epidemiologic studies;
Employee-employer dispute in which the medical history of the patient has been requested by the patient;
Evaluation by sponsor or insurer for health care coverage or benefits;
Administration of health care service plan;
Conservatorship proceedings;
Organ transplant procedure;
Encoding or encrypting data;
Disease or threat management;
Employee welfare benefit plan; and
School-linked services coordination.
Prohibits health care providers from sharing or selling medical information for a purpose unrelated to the health care services of the patient without the patient’s authorization, unless disclosure is pursuant to the previously listed exceptions (Sec. 2).
