Vote to pass a bill that specifies that public universities, colleges, and school districts may be held liable for criminal sexual conduct of an employee or agent committed during the course of their employment or service if certain conditions are met in Michigan.

Highlights:

• Specifies that public universities, colleges, and school districts may be held liable for acts of criminal sexual conduct that an employee or agent of the university, college, or school district committed during the course of their employment or service if either of the following applies (Sec. 7d): 

• The university, college, or school district was negligent in hiring, supervision, or training; or

• The university, college, or school district knew about the criminal sexual conduct and failed to report it to the appropriate law enforcement agency. 

• Specifies that public universities, colleges, and school districts may be held liable for acts of criminal sexual conduct that an employee or agent of the university, college, or school district committed during the course of their employment or service if both of the following apply (Sec. 7d): 

• The university, college, or school district had either knowledge that the employee or agent had previously committed an act of criminal sexual conduct or knowledge of the employee or agent’s propensity to act in accordance with a prior act of criminal sexual conduct; and

• The university, college, or school district failed to act or intervene to prevent the subsequent act of criminal sexual conduct.

• Specifies that it is not necessary for a criminal prosecution or other proceeding to have been brought forward for the prosecution or proceeding to have resulted in a conviction or adjudication (Sec. 7d).
