Title: Authorizes a Wider Range of Offenses to Allow Increased Punishment for Fraud Offenders

Highlights:

  • Establishes that under any of the following circumstances, the crime is classified as a misdemeanor punishable by up to 1 year imprisonment or a fine up to $2,000 or 3 times the amount of the fraudulent claim, whichever is greater (Sec. 4511):

    • The amount of the fraudulent claim(s) is less than $1,000; and

    • The fraudulent insurance act involves 1-4 fraudulent claims.

  • Establishes that under any of the following circumstances, the crime is classified as a felony punishable by imprisonment of up to 5 years or up to $10,000 or 3 times the amount of the fraudulent claim, whichever is greater (Sec 4511):

    • The amount of the fraudulent claim is between $1,000 and $19,999;

    • The fraudulent insurance act involves 5-19 false claims; and

    • The person has prior convictions for committing or attempting to commit insurance fraud.

  • Establishes that under any of the following circumstances, the crime is classified as a felony punishable by imprisonment of up to 10 years or up to $15,000 or 3 times the amount of the fraudulent claim, whichever is greater (Sec 4511):

    • The amount of the fraudulent claim is between $20,000 and $49,999;

    • The fraudulent insurance act involves 20-49 false claims; and

    • The person has 2 or more prior convictions for committing or attempting to commit insurance fraud.

  • Establishes that under any of the following circumstances, the crime is classified as a felony punishable by imprisonment of up to 15 years or up to $25,000 or 3 times the amount of the fraudulent claim, whichever is greater (Sec 4511):

    • The amount of the fraudulent claim is between $50,000 and $99,999; and

    • The fraudulent insurance act involves 50-99 false claims.

  • Establishes that under any of the following circumstances, the crime is classified as a felony punishable by imprisonment of up to 20 years or up to $50,000 or 3 times the amount of the fraudulent claim, whichever is greater (Sec 4511):

    • The amount of the fraudulent claim is $100,000 or higher; and

    • The fraudulent insurance act involves 100 or more false claims.
