Title: Establishes a 2-Year Window to Revive Civil Claims for Sexual Assault Even if the Statute of Limitations has Expired
Vote to concur with Senate amendments and pass a bill that establishes a 2-year window, from January 1, 2026, to December 31, 2027, to revive civil claims for sexual assault, even if the statute of limitations has expired in California.
Specifies that it is not necessary for a prior criminal prosecution or proceeding to have been brought as a result of the sexual assault covered by this Act (Sec. 1).
Authorizes civil action for conduct that occurred on or after January 1, 2009 and is commenced on or before January 1, 2019, that would have been barred solely because of the statute of limitations (Sec. 1).
Authorizes claims revived to be commenced beyond December 31, 2026, not including the following (Sec. 1):
A claim that has been litigated to finality before January 1, 2023;
A claim that has been compromised by a written statement agreement between the parties entered into before January 1, 2023; or
A claim brought against a public entity.
Authorizes claims seeking to recover more than $250,000 in damages arising out of sexual assault or other inappropriate behavior of sexual nature by a physician occuring at a student health center between January 1, 1988 and January 1, 2017 (Sec. 1).
