Title: Prohibits Unfair, Unconscionable, or Deceptive Acts or Practices in the Conduct of Trade or Commerce.
Vote to pass a bill that prohibits unfair, unconscionable, or deceptive acts or practices in the conduct of trade or commerce in Michigan.
Specifies unfair, unconscionable, or deceptive acts or practices as (Sec. 3):
Causing a probability of confusion or misunderstanding as to the source, sponsorship, approval, or certification of goods or services;
Using deceptive representations or designations of the geographic source of goods or services;
Misrepresenting goods or services as having sponsorship, approval, or characteristics that they do not have;
Misrepresenting deteriorated or used goods as new;
Misrepresenting the quality, standard, or grade of goods;
Disparaging the goods, services, business, or reputation of another through false representation of fact;
False advertising of goods or services;
Representing that a part, replacement, or repair service is needed when it is not;
Representing that a request for goods or services have been made when they have not;
Misrepresenting that due to a defect in the consumer’s or family of the consumer’s home, the consumer or family of the consumer are in danger if a product or service is not purchased;
Causing a probability of confusion or misunderstanding as to the authority of the salesperson to negotiate the final terms of a transaction, the legal rights, obligations, or remedies of a party in a transaction, or the terms and conditions of credit if credit is extended in a transaction;
Disclaiming or limiting the implied warranty of merchantability or fitness of use;
Representing that a consumer will receive goods or services for free or without charge without disclosing the conditions, terms, or prerequisites of using or retaining that good or service;
Failing to return a deposit, downpayment, or other payment to a consumer in accordance with agreement, advertisement, representation, or provision of law if a transaction is rescinded;
Taking advantage of a consumer’s inability to understand the terms of an agreement due to disability, illiteracy, or inability to understand the language of an agreement; or
Requiring a consumer to disclose the consumer’s social security number except if it is required for the extension of credit, background checks, fraud prevention, or the issuing or delivering of a receipt.
Prohibits a person engaged in trade or commerce that sells a ticket online for an entertainment event from (Sec. 3j):
Disclosing the name of the place of the event or the name of the person scheduled to appear at the event in the person’s URL;
Displaying a text, image, website graphic, or website design that would mislead the consumer as to the identity of the seller when buying a ticket;
Selling the ticket without disclosing the full price of the ticket;
Displaying a component of the total price of the ticket more prominently than the total price of the ticket; or
Making a false or misleading disclosure to the consumer as to the total price of the ticket.
Prohibits a person engaged in trade or commerce that sells a ticket online for an entertainment event from raising the price of the ticket after the initial display of the price of the ticket, except for when (Sec. 3j):
The consumer’s transaction period has timed out;
The increase in ticket price is due to the addition of a sales tax; or
The increase in ticket price is due to the addition of a delivery fee.
Specifies "entertainment event” as a performance, concert, exhibit, athletic game, or contest in which an entry fee is charged, the public is invited to observe, and tickets are sold (Sec. 3j).
Specifies “place of entertainment” as a public or private entertainment facility where an entertainment event is held (Sec. 3j).
