Vote to pass a bill that authorizes the labor commissioner to penalize employers for taking or withholding gratuities in California.

Highlights:

• Prohibits employers from taking gratuities from employees left by patrons, deducting wages from an employee due to gratuity, or requiring an employee to credit the gratuity as a part of their wages (Sec. 1). 

• Requires employers to pay employees the full amount of gratuity indicated on a credit card slip, without deductions for credit card fees (Sec. 1). 

• Authorizes the Labor Commissioner to investigate, issue a citation, or file a civil action for withheld gratuities (Sec. 1).
