Vote to concur with Senate amendments and pass a bill that expands the list of reasons that a school in California may request average daily attendance credits to include immigration enforcement actions.

Highlights:

• Specifies that if the average daily attendance of a school district, county office of education, or charter school during a fiscal year is decreased because of an emergency, such as natural disaster or health outbreak, then the Superintendent of Public Instruction must approximate the average daily attendance that was lost due to that event and credit it back to the appropriate institution (Sec. 1).

• Requires the Superintendent of Public Instruction to include immigration enforcement activities in the list of reasons that they may credit an institution of education for decreases in their average daily attendance (Sec. 1).

• Defines “immigration enforcement activity,” for the purpose of this Section, as any effort to investigate, enforce, or assist in the investigation or enforcement of any federal civil immigration law, including criminal immigration law that penalizes a person based on immigration status (Sec. 1).
