Vote to pass a bill that prohibits any person from selling or offering for sale a personal care product or cosmetic product containing a restricted substance as an intentionally added ingredient in any amount or lead.

Highlights:

• Defines “restricted substances” to include specified heavy metals, chemicals, additives, and related compounds (Sec. 1).

• Prohibits the sale of personal care and cosmetic products in New York containing (Sec 1):

• An intentionally added restricted substance in any amount; or

• Lead or lead compounds at or above a level deemed permissible by the department.

• Specifies that the aforementioned provision shall take effect January 1, 2029 (Sec. 1).

• Requires that the department identify products that release formaldehyde and authorizes the department to subject said products to the aforementioned restrictions (Sec. 1).

• Specifies that the department shall initially identify no more than 10 products and specifies that such restrictions shall take effect after 1 year (Sec. 1).

• Specifies that restrictions on all other identified products shall take effect after 2 years (Sec. 1).

• Authorizes the department to take certain discretionary regulatory actions (Sec. 1).

• Exempts from liability sellers who relied on product certifications from manufacturers in good faith (Sec. 1).
