Title: Prohibits Products Containing Perfluoroalkyl and Polyfluoroalkyl in New York
Vote to pass a bill that prohibits products containing perfluoroalkyl and polyfluoroalkyl in New York.
Prohibits the sale of specified products in New York containing perfluoroalkyl and polyfluoroalkyl, which (Sec. 1):
Has been intentionally added; or
Exceeds a threshold determined by the New York State Department of Environmental Conservation.
Requires that the department reevaluate the aforementioned threshold every 5 years (Sec. 1).
Specifies that restrictions on the sale of products shall take effect January 1, 2027 (Sec. 1).
Specifies that the restrictions provided for in these provisions shall not restrict the resale or reuse of used products (Sec. 1).
Requires that manufacturers provide sellers with certificates of compliance with these provisions (Sec. 1).
Establishes a violation for the issuance of a certificate for a product known to violate these provisions (Sec. 1).
Requires that the department seek third-party laboratory test results and notify all parties involved should it have reason to believe a product is being sold in violation of these provisions (Sec. 1).
Exempts from liability sellers who relied on product certificates from manufacturers in good faith (Sec. 1).
Establishes a civil penalty of up to $1,000 per day for violations of these provisions and establishes a civil penalty of up to $2,500 per day for continued violations upon enjoinment (Sec. 1).
