Title: Prohibits Discrimination Against 340B Entities
Vote to pass a bill that prohibits discrimination against 340B entities in New Mexico.
Defines “340B drug” as a drug that is purchased at a discount in accordance with the 340B program (Sec. 1).
Prohibits a manufacturer, their agent, or an affiliate of a manufacturer from (Sec. 1):
Denying, restricting, prohibiting, or interfering with the acquisition of a 340B drug by a pharmacy that is authorized to dispense 340B drugs;
Interfering with the ability of a pharmacy contracted to dispense 340B drugs from doing so; or
Requiring an applicable entity to submit any claims or data as a condition for the acquisition of a 340B drug unless the data is required by federal law.
Specifies that this Act takes effect January 1, 2026 (Sec. 2).
