Highlights:

• Defines “340B drug” as a drug that is purchased at a discount in accordance with the 340B program (Sec. 1).

• Prohibits a manufacturer, their agent, or an affiliate of a manufacturer from (Sec. 1):

• Denying, restricting, prohibiting, or interfering with the acquisition of a 340B drug by a pharmacy that is authorized to dispense 340B drugs;

• Interfering with the ability of a pharmacy contracted to dispense 340B drugs from doing so; or

• Requiring an applicable entity to submit any claims or data as a condition for the acquisition of a 340B drug unless the data is required by federal law.
