Vote to pass a bill that requires businesses in Pennsylvania to disclose information regarding subscription-based services and offer accessible methods of cancellation.

Highlights:

• Requires businesses that make automatic renewal offers or continuous service offers for goods or services to do the following (Sec. 1):

• Disclose the automatic renewal or continuous service terms, cancellation policy, and information on how to cancel in a manner that the consumer can easily retain;

• The price that will be charged after any free trial period expires, and the deadline by which the consumer must act to prevent charges;

• Allow a consumer to cancel an automatic renewal or continuous service offer exclusively online, by email, or on a website; and

• Provide a clear and conspicuous notice in the case of a material change in the terms of an automatic renewal or continuous service offer, including information on how to cancel.

• Specifies that the previous paragraph does not apply to the following (Sec. 1):

• Business entities subject to the “Health Club Act”;

• Services provided by a business entity that is regulated by the Federal Communications Commission, Federal Energy Regulatory Commission, or the Pennsylvania Public Utility Commission;

• A contract subject to regulation on natural gas competition or restructuring of electric utility industry; or

• An entity regulated by the insurance department.

• Specifies that a violation of this Act constitutes unfair methods of competition and unfair or deceptive acts or practices (Sec. 1).

• Specifies that this Act takes effect 180 days after passage (Sec. 2).
