Title: Requires Training and Procedures for Health Care Employers to Investigate and Report on Incidents of Workplace Violence
Vote to pass a bill that requires training and procedures for health care employers to investigate and report on incidents of workplace violence in Oregon.
Requires the Director of the Department of Consumer and Business Services to prescribe procedures for health care employers to investigate, collect, and report incidents of workplace violence (Sec. 1).
Defines “workplace violence” as any act or threat of physical violence, harassment, intimidation, assault, homicide, or any other threatening behavior that occurs in the workplace (Sec. 2).
Requires health care employers to provide annual workplace violence prevention and protection training for employees and any contracted security personnel (Sec. 3).
Requires health care employers to implement a workplace violence prevention and response plan which includes procedures for the following (Sec. 3):
Identifying employees involved in an incident of workplace violence;
Conducting post-incident employee interviews to gather factual details about an incident of workplace violence; and
Implementing post-incident response strategies to address first aid, medical care, and trauma counseling needs resulting from the incident.
Specifies that workplace violence prevention and protection training must include predictive factors, visual cues to identify indicators of workplace violence, and responses to active shooter incidents (Sec. 3).
Requires the Department of Consumer and Business Services to submit an annual report on workplace violence that includes the following for each incident (Sec. 5):
The location of the incident;
The nature of the incident;
The nature and severity of any injuries stemming from the incident;
The job titles of any employees injured in the incident; and
The change in the number of incidents compared to the previous report.
Prohibits health care facilities from requiring any worker to wear an identification badge that includes their last name (Sec. 8).
Requires covered health care entities to implement flagging systems to communicate potential threats of violence or disruptive behavior using health record flags and visual flags (Sec. 9).
Requires all hospitals in Oregon to install a bullet-resistant barrier or enclosure at each emergency room intake area (Sec. 10).
Requires home health care service entities to collect information necessary to identify and assess potential health and safety risks, including workplace violence, as part of any client intake process (Sec. 11).
Requires home health care service entities to provide training to staff on recognizing hazards that are commonly encountered in home health care service (Sec. 13).
