Vote Smart's Synopsis:

Vote to concur with House amendments and pass a bill that authorizes delays in civil nonpayment actions against parents who meet certain criteria of social need in Oregon.

Highlights:

• Authorizes a defendant to move to reschedule a trial in an action for possession based on nonpayment under a declaration that the individual (Sec. 2):

• Is the parent of a child under 12 months of age living in the dwelling unit;

• Is a recipient of medical assistance;

• Was approved by the Oregon Health Authority or a coordinated care organization to receive health-related social needs housing supports; and

• Delivered documentation to the plaintiff showing approval for health-related social needs housing supports.

• Requires the court to grant the motion to reschedule a trial between 90 and 104 days from the date of the motion if all of the criteria described in the previous paragraph are met (Sec. 2).

• Requires disclosure by the Judicial Department of the ability to delay eviction for individuals with a child under 1 year old and who have been approved for rent assistance through Medicaid (Sec. 4).

• Requires the Housing and Community Services Department to prioritize families with children under 12 months of age in adopting policies to promote housing stabilization, and to report on the rate of unsheltered homelessness among children annually (Sec. 9).
