Vote to concur with Senate amendments and pass a bill that prohibits manufacturers from interfering in the sale or delivery of 340B drugs in Oregon and provides penalties.

Highlights:

• Prohibits manufacturers or third parties on behalf of a manufacturer from denying, restricting, prohibiting, or otherwise interfering with the acquisition, delivery, or dispensation of a 340B drug by a pharmacy that has contracted with a covered entity to receive and dispense such drugs (Sec. 1).

• Prohibits manufacturers or third parties on behalf of a manufacturer from requiring a covered entity to submit a claim or utilization review data as a condition for the acquisition, delivery, or dispensation of a 340B drug by a pharmacy that is in contract with a covered entity (Sec. 1).

• Authorizes the State Board of Pharmacy to impose a civil penalty on a manufacturer for each violation under Section 1 of this Act in an amount up to $5,000 per day (Sec. 2).
