Title: Establishes Criminal Penalty for Trespassing Near Schools or Day-Care Centers
Vote to pass a bill that establishes a new Class A misdemeanor for individuals who trespass on or within 250 feet of school or day-care property in Texas.
Expands Penal Code by adding Section 30.055 to create a new offense of “Trespass on or Near School or Day-Care Center Property” (Sec. 1).
Defines key terms (Sec. 1):
“School” as a public or private elementary or secondary school (Sec. 30.055).
“Public property” as streets, highways, alleys, public parks, and sidewalks (Sec. 30.055).
“School or day-care center property” as all land or buildings owned or leased by the school or day-care center, and any location where a school or day-care-sponsored activity is being conducted (Sec. 30.055).
Establishes that offense is committed if the person (Sec. 30.055):
Enters or remains on school, day-care property, or public property within 250 feet;
Does not have a child-related reason involving custody or responsibility for a student or explicit written permission from the school or day-care; or
Receives a request to leave from an administrator, educator, or security personnel and does not leave.
Defines the offense as a Class A misdemeanor (Sec. 30.055).
Establishes effective date as September 1, 2025. (Sec. 2).
