Title: Authorizes Notice Requirements for Groundwater Transfer Permit Applications Across Conservation Districts
Vote to concur with Senate amendments and pass a bill that authorizes applicants that are transferring groundwater out of a conservation district must provide certified mail and public notice to nearby districts affected by the transfer in Texas.
Expands Water Code, Section 36.122 to require districts to adopt notice rules for groundwater transfer applications (Sec. 1).
Requires notice to be (Sec. 36.122(d-1)):
Paid for by the applicant;
Sent by certified mail to each adjacent and relevant district, as well as the commissioners court that is located in or overlies that aquifer from which the groundwater would be produced; and
Published in newspapers of the affected counties.
Establishes the effective date as September 1, 2025 (Sec. 2).
