Vote Smart's Synopsis:

Vote to pass a bill that establishes the Family Neonatal Intensive Care Leave Act in Illinois.

Highlights:

• Authorizes an employee of an employer with 16-50 employees to use up to 10 days of unpaid neonatal intensive care leave while any child of the employee is a patient in a neonatal intensive care unit (Sec. 10).

• Specifies that an employee of an employer with 51 or more employees shall be entitled to up to 20 days of unpaid neonatal intensive care leave while a child of the employee is a patient in a neonatal intensive care unit (Sec. 10).

• Specifies the following requirements for employers in the case that an employee takes neonatal intensive care leave (Sec. 10):

• They must reinstate the employee to their former position or a substantially equivalent one upon the conclusion of leave;

• They must maintain all benefits - including healthcare - for the employee that were held or accrued prior to taking leave; and

• They must not require the employee to provide a replacement worker.
