Vote to pass a bill that establishes the Age-Appropriate Online Design Code Act in Nebraska.

Highlights:

  • Requires that online services provide minors with default safeguards that (Sec. 3-4):

    • Limit the ability of users to communicate with minors;

    • Prevent the sharing of minors’ personal data and locations;

    • Allow minors to opt-out of features and purchases;

    • Control minors’ personalized recommendations; and

    • Limit the time minors engage with the service.

  • Prohibits online service providers from collecting minors’ data beyond what is strictly necessary and prohibits the use of data beyond the time-limited use for which it was collected (Sec. 5). 

  • Prohibits online service providers from engaging in targeted advertising to minors (Sec. 5). 

  • Requires that online service providers provide minors with a clear indication when geolocation data is being collected, parental monitoring is being actively used, and under certain other circumstances (Sec. 5-6).

  • Limits notifications and push-alerts to minors between the hours of 10pm - 6am and 8am - 4pm (Sec. 5).

  • Requires that parents be allowed to monitor and restrict the accounts of their minor children (Sec. 6).

  • Requires that online service providers establish channels for minors and parents to report harm (Sec. 7).

  • Prohibits online service providers from showing advertisements for prohibited products such as narcotic drugs, tobacco products, gambling, and alcohol minors (Sec. 8).

  • Prohibits online service providers from using dark patterns to subvert or impair minor autonomy, decision-making, or choice (Sec. 8).

  • Specifies that violations of the aforementioned provisions shall constitute deceptive trade practices and establishes civil penalties (Sec. 9).

  • Specifies that the aforementioned provisions shall take effect July 1st, 2026 (Sec. 9-10).
