Title: Increases Penalties for Acts of Violence and Other Actions Which Contribute to a Riot
Vote to pass a bill that increases criminal penalties for acts of violence and other actions which contribute to a riot in Wisconsin.
Prohibits government officials from limiting or restricting the authority of a law enforcement agency to arrest or detain individuals involved in a riot or vandalism activity (Sec. 1).
Authorizes individuals who suffer injury or loss to person or property as a result of a riot activity to bring civil action against the person in violation, including an order requiring the offender to fix or repair damaged property (Sec. 2).
Defines “riot” as a public disturbance that involves an act of violence, or a threat of an act of violence, as part of an assembly of at least three individuals that constitutes a clear and present danger of damage (Sec. 3).
Defines “incite” as urging, promoting, organizing, encouraging, or instigating other persons, and specifies that it does not mean to advocate beliefs (Sec. 3).
Classifies the incitement of another individual to commit a riot as a Class I felony (Sec. 3).
Classifies acts of violence while participating in a riot as a Class H felony (Sec. 3).
