Vote Smart's Synopsis:

Vote to pass a bill that authorizes religious institutions, public schools, and universities to build housing on their land in Colorado.

Highlights:

• Defines “qualifying property” as real property that contains no more than five acres of land that has been owned by a faith-based organization, a school district, or a state college or university for at least five years (Sec. 1).

• Requires subject jurisdictions of populations greater than 2,000 people to allow a residential development to be constructed on a qualifying property, subject to an administrative approval process (Sec. 1).

• Specifies that this Section does not prevent a subject jurisdiction from enforcing any regular standards for residential infrastructure on a qualifying property (Sec. 1).

• Specifies that a subject jurisdiction shall not (Sec. 1):

• Prevent construction of a housing development on the basis of height if the tallest structure will not be taller than three stories or 45 feet, or if the tallest structure will comply with the standards for the qualifying property’s zoning district;

• Prevent construction of a housing development based on the number of dwelling units in the development; or

• Apply standards to a housing development on a qualifying property that are more restrictive than the standards that the subject jurisdiction applies to similar housing.

• Requires subject jurisdictions to allow the following uses in a residential development on qualifying property (Sec. 1):

• Childcare; and

• The provision of recreational, social, or educational services provided by community organizations for use by the residents of the development and the surrounding community.
