Title: Expands Prohibited Dissemination of Intimate Imagery to Include Digitally Created or Altered Depictions
Vote to pass a bill that expands prohibited dissemination of intimate imagery to include digitally created or altered depictions.
Expands the definition of “image” to include digitally created, manipulated, or altered depictions that are reasonably realistic, such as AI-generated or deep fakes (Sec. 1, ORS 163.472(3)(b)).
Exempts disclosures for law enforcement investigations, legitimate medical, scientific, or educational purposes, lawful public interest, reporting unlawful conduct, and specific consensual or commercial images (Sec. 1, ORS 163.472(4)).
Establishes enhanced penalties for repeat offense of Class C felony, while first offense remains a Class A misdemeanor (Sec. 1, ORS 163.472(2)).
Specifies the elements of the crime by requiring that the defendant act with intent to harass, humiliate, or injure, knows or should know the subject did not consent, and that both the subject and a reasonable person would be harmed by the disclosure (Sec. 1, ORS 163.472(1)).
