Title: Establishes Prohibitions on Assault Rifles, Assault Shotguns, .50 Caliber Rifles, and High-Capacity Detachable Magazines
Vote to pass a bill that establishes prohibitions on assault rifles, assault shotguns, .50 caliber rifles, and high-capacity detachable magazines in Hawaii.
Establishes state prohibitions on the following types of firearms in Hawaii, including (Sec. 1-4):
Assault rifles;
Assault shotguns;
.50 caliber rifles; and
High-capacity detachable magazines.
Defines “assault shotgun” as a semiautomatic shotgun that has one or mor eof the following characteristics, including (Sec. 1-4):
Accepts a detachable magazine;
Has a revolving cylinder;
A pistol grip or thumbhole stock;
Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
A folding, telescoping, or detachable stock, or a stock that is otherwise foldable or adjustable in a manner that operates to reduce the length, the size, or any dimension, or otherwise enhances the concealability of the weapon;
A grenade launcher; or
A fixed magazine with the capacity to hold more than 5 rounds.
Defines “.50 caliber rifle” as a centerfire rifle capable of firing a .50 caliber cartridge (Sec. 1-4).
Defines “detachable magazine” as an ammunition feeding device that may be removed from a firearm without disassembly of the firearm action, including an ammunition feeding device that may be readily removed from a firearm with the use of a bullet, cartridge, or accessory, or other tool, or any other object that functions as a tool, including a bullet or cartridge (Sec. 1-4).
Specifies that these provisions shall not apply to any individual in possession of any of these types of firearms before July 8, 2025 (Sec. 1-4).
Specifies that indidivals authorized under this bill to possess any of these types of firearms to possess them only (Sec. 1-4):
On private property owned or immediately controlled by the individual;
On private property that is not open to the public with the express permission of the person who owns or immediately controls the property;
While on the premises of a licensed firearms dealer or gunsmith for lawful repair;
While engaged in the legal use of the assault rifle, assault shotgun, or .50 caliber rifle at a properly licensed firing range or sport shooting competition venue; or
While traveling to or from the pre-approved locations.
Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the Governor (Sec. 8).
