Title: Requires a Parent/Guardian, Foster Parent or Kinship Placement Have Access to Their Child's Medical Records
Vote to concur with Senate amendments and pass a bill that requires a parent/guardian, foster parent or kinship placement have access to their minor child's medical records in West Virginia.
Authorizes a parent, guardian, foster parent, or kinship to access health records of their minor child unless otherwise ordered by a court or under the following (Sec. 1):
The minor child has graduated from high school or equivalent;
The minor child is emancipated; or
The minor child is married.
Specifies that permission from or by the minor shall not be required or requested as a prerequisite for the partner or legal guardian to obtain the medical records, except for the exemptions above (Sec. 1).
Authorizes the Bureau of Medical Services and the Bureau for Social Services shall provide electronic access to a child’s medical records taken into their custody to the managed care organization, the child placing agency, and the person having temporary custody of the child (Sec. 1).
