Vote to adopt a conference report vote and pass a bill that requires an individual be a citizen of the United States before being eligible to vote in South Dakota.

Highlights:

  • Requires an individual to meet all of the following requirements, at the time of the election, in order to vote in South Dakota (Sec. 1):

    • Is a citizen of the United States;

    • Lives in South Dakota;

    • Is at least 18 years old;

    • Is not otherwise disqualified; and

    • Complies with voter registration requirements.

  • Specifies that an individual is guilty of a Class 1 misdemeanor if they knowingly make false statements to register as a voter (Sec. 2). 

  • Specifies that an individual is guilty of a Class 1 misdemeanor if they vote while knowing they are not a qualified voter (Sec. 3). 

  • Specifies that an individual is guilty of a Class 6 felony if they impersonate a registered voter (Sec. 4). 

  • Specifies that an individual is guilty of a Class 6 felony if they vote in another state in addition to South Dakota (Sec. 5).
