Title: Establishes the Wage Payment Integrity Act
Vote to pass a bill that establishes the Wage Payment Integrity Act, which increases protections against wage theft in New York.
Establishes the Wage Payment Integrity Act in New York (Sec. 1)
Amends the definition of “wages” to include compensation that is not payable solely at the employer’s discretion (Sec. 1).
Requires employers to notify an employee in a clear and timely manner that the employer has the full right to decide whether or not to give a bonus, in order for such bonus to be excluded from “wages” (Sec. 1).
Requires employers to notify employees in writing at least 7 days in advance of any changes to their terms of employment, unless those changes are included in the employee’s wage statement (Sec. 3).
Specifies a violation of these provisions as a misdemeanor (Sec. 5).
Exempts any individual in a bona fide executive, administrative, or professional role whose earnings exceed $1,300 per week from the provisions of this bill (Sec. 5).
Specifies that the provisions of this bill shall take effect immediately upon passage (Sec. 6).
