Title: Establishes Grounds for Attachment and Streamlines Wage Claims Procedures
Vote to pass a bill that establishes grounds for attachment and streamlines wage claims procedures in New York.
Establishes grounds for asset attachment to include wage claims in New York (Sec. 2).
Defines “wage claims” as including, but not limited to, claims of any of the following (Sec. 1):
Unpaid, minimum, overtime, and spread-of-hours pay;
Unlawfully retained gratuities;
Unlawful deductions from wages;
Unpaid commissions; and
Unpaid benefits and wage supplements.
Authorizes the court to issue a temporary restraining order to freeze assets without employer notice if an employee files for an order of attachment (Sec. 1).
Requires that when attachment is sought and if the employer contests the motion, the court shall hold a hearing within 10 days (Sec. 2)
Authorizes victims of wage theft to hold the 10 members with the largest ownership interests in a company personally liable for wage theft (Sec. 6).
Specifies that the provisions of this bill shall take effect 13 days after passage and that the procedures and rights established may be used for claims that arose prior to this date (Sec. 11).
