Vote to pass a bill that prohibits state employees from working remotely, unless a state of emergency is declared in Kentucky.

Highlights:

• Prohibits an employee of the executive branch of state government from working remotely unless the Governor declares an emergency (Sec. 1). 

• Requires that the Governor specifically state that remote work is permitted during the emergency and list which employees are permitted to work remotely (Sec. 1). 

• Prohibits an employee of the judicial branch of state government from working remotely unless the Chief Justice of the Supreme Court declares an emergency (Sec. 1). 

• Requires that the Chief Justice of the Supreme Court specifically state that remote work is permitted during the emergency and list which employees are permitted to work remotely (Sec. 1). 

• Prohibits an employee of the legislative branch of the state government from working remotely unless the Speaker of the House of Representatives and the President of the Senate jointly declare an emergency (Sec. 1). 

• Requires that the Speaker of the House of Representatives and the President of the Senate specifically state that remote work is permitted during the emergency and list which employees are permitted to work remotely (Sec. 1). 

• Authorizes the secretary of the Personnel Cabinet, director of the Administrative Office of the Courts, or the director of the Legislative Research Commission to allow for up to 2 non-emergency-related remote work days for their respective employees (Sec. 1). 

• Specifies that the provisions of this bill shall not apply to any of the following individuals (Sec. 1):

• Justices of the Supreme Court;

• Employees of the Department of Kentucky State Police;

• Any employee of state government involved in motor vehicle enforcement, plumbing inspections, health inspections, or building inspections;

• Any employees whose job responsibilities require them to be away from their primary work station at least 50% of the time; and

• Any employee whose primary responsibilities involve managing information technology systems and who are authorized to work remotely as part of their contract.

• Specifies that the provisions of this bill shall not prevent any branch of state government from complying with the Americans with Disabilities Act of 1990 (Sec. 1).
