Title: Establishes a Felony Charge for a Parent to Seek Care or for Their Transgender Youth

Vote to pass a bill that establishes a felony charge for a parent to seek care for a transgender youth or a doctor to provide it, or to alter the appearance of a child in Montana.

Highlights:

  • Expands the state definition of endangering the welfare of a child by a parent, guardian, or other adult individual to include procuring or providing treatments to alter the child’s body regarding the child’s sex, including (Sec. 1):

    • Surgical procedures;

    • Puberty blockers; or

    • Doses of estrogen, testosterone, or any other androgen at a level higher than that naturally occurring in the body.

  • Authorizes parents of children less than 16 years of age to request a person 18 years or older to stop contacting their child through verbal or written means of communication (Sec. 1).

  • Establishes a felony status for the conviction for this subsection of this crime (Sec. 1).

  • Establishes a maximum fine of $10,000 for individuals convicted of violation of this bill (Sec. 1).

  • Establishes a maximum term of imprisonment of 5 years for individuals convicted for violations of this bill (Sec. 1).

  • Establishes a maximum fine of $25,000 for individuals who are convicted of causing major bodily harm to a child from a violation of this bill (Sec. 1).

  • Establishes a maximum term of imprisonment of 10 years for individuals who are convicted of causing major bodily harm to a child from a violation of this bill (Sec. 1).

  • Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the Governor (Sec. 2).
