Vote to pass a bill that increases civil penalties for commercial driver violations in South Dakota.

Highlights:

• Authorizes the state attorney for the county in which a violation of subdivision 32-12A-5(4) occurs to commence a civil in rem proceeding of not more than $20,537 against the employer (Sec. 1).

• Extends disqualification of the convicted driver to specify that they shall also be subject to a civil penalty of no less than $3,691 for the first conviction and $7,921 for the second conviction (Sec. 2).

• Authorizes the attorney for the county where violation of subdivision 32-12A-5(3) to commence a civil rem proceeding of not less than $7,155 and no more than $39,615 against the employer (Sec. 3).

• Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the Governor (Sec. 4).
