Title: Authorizes Low-Risk Sex Offenders to Ask the Court to Remove Them from the State Registry Early
Vote to concur with Senate amendments and pass a bill that authorizes low-risk sex offenders to ask the court to strike them from the state registry early in North Dakota.
Authorizes low-risk sex offenders to ask the court to strike them from the state registry early in North Dakota after 7 years of registration (Sec. 1).
Specifies that the court may grant the petition if the following provisions are completed, including (Sec. 1):
Finding that the sexual offender has maintained a clean record during the offender's period of registration, meaning the following; and
Not convicted of a felony offense;
Not convicted of a sexual offense;
Completed, without revocation, a period of supervised release, probation, or parole; and
Has completed any court-ordered sexual offender treatment program and any other court-ordered treatment program, if any. (This subdivision applies to any sexual offender treatment program completed regardless of whether the program was completed while the sexual offender was incarcerated, released, on parole, or on probation).
Continued registration is not necessary for public protection and relief from registration is in the best interests of society.
Establishes that these provisions of this bill shall apply retroactively to any sexual offender who has complied with these requirements for at least 7 years before the effective date of this bill (Sec. 2).
Specifies the provisions of this bill shall take effect immediately upon passage and approval by the Governor (Sec. 2).
