Highlights:

  • Requires health insurance policy that provides coverage for prescription contraceptives to include coverage for the following (Sec. 3406jj):

    • Requires a 12-month supply of contraceptive prescription that is within the covered insured’s health plan or available through the insurer’s network;

    •  If other prescriptions are covered, authorize the coverage of the following: 

      • Health insurance policy; 

      • Outpatient consultations; 

      • Examinations; 

      • Procedures; and 

      • Other medical services need to prescribe, deliver, or remove a prescription contraception. 

    • Specifies that a 12-month supply of contraceptives must be dispensed for the 12 months regardless of whether the insured was covered under the health insurance policy at the time it was first dispensed; 

    • Specifies that contraceptive prescription  coverage may still be subjected to the provision of the health insurance policy that applies to other prescribed medication; 

    • Prohibits insurers from imposing restrictions or medical control on the supply or coverage of prescription contraception; and 

    • Specifies that insurers are not required to provide coverage for a 12-month supply in a 1-month period before the end of an insured’s plan year. 

  • Specifies that the provisions of this bill shall take effect beginning December 31, 2025 (Sec. 2).
